NERC STandards

Text Box: The Energy Policy Act of 2005 authorized the creation of a self-regulatory electric reliability organization (ERO) that spans North America, with Federal Energy Regulatory Commission (FERC) oversight in the United States.  The legislation makes compliance with North American Electric Reliability Council (NERC) and regional reliability standards mandatory and enforceable; presently compliance is voluntary (through June 2007) in the United States.

On January 3, 2007, NERC filed comments with FERC regarding the October 2006 NOPR.  The comments express NERC’s full support of the Commission’s proposal to make 83 of 107 proposed reliability standards enforceable and mandatory, and to recognize as “good utility practice” the remaining 24 proposed standards. The 24 standards are pending approval subject to NERC’s submittal of additional information.  

NERC’s January filing brings the cycle of regulatory issuances and compliance filings on the first major set of proposed standards to the doorstep of what could be the final issuance ― the anticipated FERC order that will help fulfill the vision of establishing mandatory and enforceable standards. However, work still remains as NERC and the industry forge ahead on standards development and ERO-related activities.

MLJ Energy has been actively working with clients and NERC Regional Reliability Councils for several years in the development of these compliance procedures and Manuals.
